These Terms & Conditions ("Terms") govern your access to and use of the website www.autismpediatrictherapy.com (the "Website") and all services provided by Autism Pediatric Therapy & Learning Center ("we," "us," or "our"), including but not limited to Applied Behavior Analysis (ABA) therapy, evaluations, parent training, workshops, and related pediatric autism services in Houston and Pearland, Texas.

By accessing the Website, submitting information via contact forms, scheduling a discovery call, texting or calling (713) 355-0623, or receiving services, you agree to be bound by these Terms and our Privacy Policy (available at www.autismpediatrictherapy.com/privacy-policy), which is incorporated herein by reference. If you do not agree, you must not use the Website or our services.

We may update these Terms at any time. Changes will be posted on the Website with the updated Effective Date. Your continued use after changes constitutes acceptance. Review these Terms periodically.

1. Nature of Services

Autism Pediatric Therapy is a private pediatric therapy center specializing in early intervention ABA therapy for children aged 18 months to 12 years. Services include:

  • One-on-one and group ABA therapy
  • Behavioral assessments and individualized treatment plans
  • Language, social, motor, and daily living skills training
  • Parent/caregiver coaching and weekly training sessions
  • In-home behavior intervention plans
  • Insurance coordination and billing assistance
  • Free community workshops and sibling social programs
  • IEP/ARD advocacy support

We are not a crisis intervention, medical, or emergency service. In emergencies, call 911 or your local crisis hotline.

2. Eligibility & Parental Consent

You represent that:

  • You are 18 years or older and the legal parent or guardian of any child for whom services are requested.
  • All information provided (e.g., child’s name, date of birth, insurance, behaviors) is accurate and complete.
  • You have authority to consent to treatment and share your child’s information.

We comply with HIPAA, COPPA, and Texas law. No services will be initiated without proper consent and insurance verification (where applicable).

3. Insurance & Payment Responsibilities

Accepted Insurance

We partner with most major employer-sponsored insurance plans, including but not limited to:

  • Aetna
  • Cigna
  • Anthem
  • Blue Cross Blue Shield
  • United Healthcare

We do not accept Medicaid or plans that exclude autism/ABA coverage. If your plan is not listed, contact us to verify network status.

Verification & Authorization

  • We will verify benefits and obtain pre-authorization before services begin.
  • You are responsible for understanding your plan’s coverage, including:
    • Deductibles, copays, coinsurance
    • Session limits or annual maximums
    • Requirements for medical necessity documentation
  • If authorization is denied or expires, services may be paused until resolved or paid privately.

Private Pay

If paying out-of-pocket, rates and payment terms will be provided in writing before services start. All fees are due at the time of service unless a payment plan is pre-approved.

No Surprises Act Compliance

You will receive a Good Faith Estimate of expected charges for non-emergency services upon scheduling or request, as required by federal law.

4. Appointment Policies

Scheduling

  • Sessions are scheduled after insurance clearance and intake completion.
  • Flexible hours: Mon–Fri 8:00am–5:30pm, Sat 8:00am–1:00pm (subject to availability).

Cancellations & No-Shows

  • 24-hour notice required for cancellations or rescheduling.
  • Late cancellations or no-shows may incur a fee (up to the full session cost), billable to you if not covered by insurance.
  • Repeated no-shows may result in discharge from services.

Lateness

If you are more than 15 minutes late, the session may be shortened or rescheduled at our discretion.

5. Consent to Treatment & Risks

By enrolling your child:

  • You consent to ABA therapy, behavioral assessments, data collection (e.g., skill acquisition charts), and parent training.
  • You acknowledge that ABA involves positive reinforcement, prompting, and data-driven decision-making, but results are not guaranteed.
  • Potential risks include temporary increases in challenging behavior during skill acquisition ("extinction bursts"). These will be explained and managed by your BCBA.

You may withdraw consent at any time in writing, though prior fees remain due.

6. SMS & Communication Consent

By providing a mobile number, you opt in to receive SMS/text messages for:

  • Appointment reminders
  • Insurance updates
  • Session summaries
  • Parent training tips
  • Workshop invitations (with separate marketing opt-in)

This consent complies with the TCPA and is not required to receive treatment. Standard message/data rates may apply.

  • Security: SMS is not fully secure. Do not send sensitive PHI via text. See full SMS Disclosure in our Privacy Policy.

7. Intellectual Property

All content on the Website, including text, images, logos, charts, and branding, is owned by Autism Pediatric Therapy or licensed to us and protected by copyright and trademark law.

You may not:

  • Copy, modify, or distribute content without written permission.
  • Use our name, logo, or materials to imply endorsement.

8. Website Use & Prohibited Conduct

You agree not to:

  • Use the Website for unlawful purposes.
  • Submit false, misleading, or harmful information.
  • Attempt to gain unauthorized access to our systems.
  • Interfere with Website functionality (e.g., via bots, scraping).

We may suspend access for violations.

9. Disclaimers

  • The Website and services are provided "as is" without warranties of any kind.
  • We do not guarantee specific outcomes from therapy.

10. Limitation of Liability

To the fullest extent permitted by law, Autism Pediatric Therapy, its directors, employees, and agents will not be liable for:

  • Service interruptions due to technical or insurance issues.

Liability is limited to the amount paid for services in the prior 12 months.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

  • Your misuse of the Website or services.
  • Inaccurate information provided.
  • Violation of these Terms.

12. Termination

We may terminate or suspend services if:

  • You breach these Terms.
  • Insurance coverage lapses without alternative payment.
  • Continued treatment is not clinically appropriate.

You may terminate services with written notice. Outstanding balances remain due.

13. Governing Law & Dispute Resolution

These Terms are governed by Texas law. Any disputes will be resolved in the courts of Harris County, Texas.

14. HIPAA Notice of Privacy Practices

Our use and disclosure of Protected Health Information (PHI) is governed by our Privacy Policy and HIPAA Notice of Privacy Practices (provided at intake and available on request). You will receive a signed acknowledgment of receipt.
